Términos y Condiciones Stripe Climate

Por favor, lea atentamente los Términos y Condiciones de Climate, ya que contienen los términos y condiciones relacionados con su participación en Stripe Climate. Los Términos y Condiciones de Stripe Climate (los “Terminos y Condiciones Climate”) son aplicables a sus contribuciones voluntarias de Stripe Climate, tal y como se define a continuación.

1. Acuerdo

En el momento en el que usted decide utilizar Stripe Climate, acepta expresamente lo dispuesto en los Términos y Condiciones Climate, el Contrato de Prestación de Servicios de Stripe así como en cualquier actualización o modificación a cualquiera de estos términos y condiciones realizada de tiempo en tiempo por Stripe. Los términos y condiciones aplicados a los Servicios de Stripe le son aplicables a Stripe Climate. Los Términos y Condiciones Climate complementan el Contrato de Prestación de Servicios de Stripe, mismo que generalmente regula su utilización de los Servicios de Stripe y está incorporado por referencia a los Términos y Condiciones Climate. En la medida en que exista un conflicto en relación con Stripe Climate entre el Contrato de Prestación de Servicios de Stripe y los Términos y Condiciones Climate, estos últimos prevalecerán sobre el primero. En cuanto a los términos con mayúscula inicial no definidos en estos Términos y Condiciones Climate, las definiciones aplicables se establecen en el Contrato de Prestación de Servicios de Stripe.

2. Stripe Climate

“Stripe Climate” es un paquete de funciones que permite a los usuarios crear y ejecutar su propio programa climático corporativo. Stripe lleva a cabo investigaciones sobre los proyectos Climáticos que Stripe determina que merecen ser financiados y compra servicios para la eliminación de carbono. Stripe también ha creado una marca relacionada con el Clima que está disponible para ser incluida en sus páginas de pago, sin contraprestación alguna. Los usuarios tienen la oportunidad de contribuir y tener un impacto en el sector de la eliminación del carbono haciendo contribuciones voluntarias a Stripe Climate. Actualmente, Stripe Climate está en beta.

3. Fondos de Stripe Climate

Usted elige el monto que se asignará voluntariamente a Stripe Climate, ya sea como un porcentaje de sus ingresos o un monto mensual fijo (dichos montos se denominan los “Fondos Stripe Climate”). Stripe asignará la totalidad de dichos Fondos Stripe Climate a la tarea de lograr avances en el desarrollo del sector de la eliminación del carbono por medio de actividades como la compra de toneladas métricas de eliminación de carbono o el financiamiento de la investigación y el desarrollo de nuevas tecnologías de eliminación del carbono.

Dado que el objetivo de Stripe Climate es ayudar a desarrollar el sector de la eliminación del carbono, muchos de los proyectos y empresas financiados se encontrarán en sus etapas iniciales y su supervivencia y/o éxito haciendo frente a los problemas climáticos no están garantizados. Si bien todos los Fondos Stripe Climate se destinarán a la promoción y desarrollo del sector de la eliminación del carbono, muchas veces, los plazos para desarrollar nuevas tecnologías son largos y el resultado puede no ser inmediato, y siempre existe el riesgo de que las empresas a las que Stripe les compra la eliminación del carbono incumplan con sus objetivos (y no se recuperen los fondos invertidos). Incluso si dichas empresas tienen éxito en la obtención de sus objetivos, los proyectos pueden tardar años en producir esos resultados.

Sus montos de contribución destinados a Climate no pueden gastarse inmediatamente después de ser deducidos de su cuenta, sino más bien una vez que Stripe haya podido identificar un proyecto en el cual invertir. Stripe hará esfuerzos razonables para financiar proyectos que generen impacto y, cuando se le proporcionen sugerencias sobre cuánto dinero destinar voluntariamente a Stripe Climate, es en última instancia, su decisión sobre si asignar voluntariamente los fondos a Stripe Climate y en su caso cuánto a asignar. Stripe le proporcionará regularmente información sobre cómo se asignaron los fondos. Debido a que muchos de los proyectos en este sector están todavía en sus etapas iniciales, los servicios de eliminación de carbono adquiridos por Stripe o calificarán como créditos de carbono que usted pueda utilizar para fines de compensación de carbono. Stripe no destinará los Fondos Stripe Climate a sus propios gastos corporativos o administrativos. Una vez que usted elija participar, Stripe puede deducir los Fondos Stripe Climate elegidos del saldo de su Cuenta Stripe y de su Cuenta de Pago, los cuales se pueden deducir por cada transacción o se pueden acumular durante un período de tiempo, tal y como se describe en su Tablero de Control Stripe. Usted puede dejar de participar en Climate Stripe en cualquier momento.

Please read the Climate Terms carefully as they contain terms and conditions relating to your participation in Stripe Climate. The Stripe Climate Terms (“Climate Terms”) are terms that apply to your voluntary allocations to Stripe Climate, as defined below.

1. Agreement

When You opt-into using Stripe Climate, you expressly agree to the terms and conditions of the Climate Terms, the Stripe Services Agreement, and any updates or modifications to either of these terms made from time to time by Stripe. Terms applying to Stripe Services apply to Stripe Climate. The Climate Terms supplement the Stripe Services Agreement, which generally governs your use of Stripe Services, and is incorporated into the Climate Terms by reference. To the extent that there is a conflict between the Stripe Services Agreement and the Climate Terms related to Stripe Climate, the Climate Terms will prevail. For capitalized terms not defined in these Climate Terms, the applicable definitions are set out in the Stripe Services Agreement.

2. Stripe Climate

“Stripe Climate” is a suite of features that enables users to create and run their own corporate climate program. Stripe conducts research into Climate projects that Stripe determines deserve funding, and purchases carbon removal. Stripe has also created Climate related branding which is available to include on your payment pages, all for no consideration. Users have an opportunity to make an impact in the carbon removal field by making voluntary contributions to Stripe Climate. Stripe Climate is currently in beta.

3. Stripe Climate Funds

You choose the amount to voluntarily allocate to Stripe Climate, either as a percentage of your revenue or a flat monthly amount (such amounts, “Stripe Climate Funds”). Stripe will allocate the entirety of such Stripe Climate Funds to advance the carbon removal field, through activities like purchasing metric tons of carbon removal or funding research and development for new carbon removal technologies.

As the goal of Stripe Climate is to help advance the field of carbon removal, many projects and companies funded will be in their early stages and their survival and/or success in addressing climate issues is not guaranteed. While all Stripe Climate Funds will be spent to advance the carbon removal field, the development timelines of many new technologies are long and the resulting impact may not be immediate, and there is always a risk of non-delivery (and non-recovery of paid funds) by the companies that Stripe purchase carbon removal from. Even if they are successful in obtaining results, Projects may take years to produce those results.

Your Climate contribution funds may not be spent immediately after being deducted from your account, but rather after Stripe has been able to identify and contribute to a project. Stripe will use reasonable efforts to fund impactful projects and when providing you with suggestions on how much to voluntarily allocate to Stripe Climate, however, it is ultimately your decision as to whether to voluntarily allocate funds to Stripe Climate and how much to voluntarily allocate. Stripe will regularly provide you with information about how funds were allocated. Because many of the projects in this field are still in early stages, carbon removal purchased by Stripe will not qualify as carbon credits that you can use for carbon offset purposes. Stripe Climate is not offered by a charity or 501(c)(3) at this time. Stripe Climate Funds you voluntarily allocate to Stripe may not be considered charitable deductions. Stripe Climate Funds are not refundable.

Stripe will not apply Stripe Climate Funds towards its own corporate or administrative costs. Once you choose to opt-in, Stripe may deduct the elected Stripe Climate Funds from your Stripe Account balance and from your Payout Account, funds may be deducted on a per transaction basis, or aggregated over a period of time, as described in your Stripe Dashboard. You may opt out of Stripe Climate at any time.
