Alipay Terms of Service

These Alipay Terms of Service ("Terms") govern your use of the Alipay services to receive payments from Customers made using the Alipay wallet. The Alipay services are made available to you by AUS Merchant Services Inc. and its affiliates (collectively, “Alipay”) and include the authorisation and  the processing of Alipay wallet payments. Unless otherwise stated, a capitalised term used and not defined in these Terms has the meaning given to such term in the Stripe Services Agreement ("Agreement"). These Terms form part of the Agreement and remain subject to the terms and conditions of the Agreement. To the extent these Terms conflict with the Agreement, these Terms will prevail, but solely as applicable to the Alipay services. By using the Alipay services, you agree to comply with these Terms

1. Transaction Information    

Alipay will not be responsible for any claims or liabilities arising from delays in processing Transactions due to your failure to submit necessary records and information for Transactions submitted by Stripe using the Alipay services. You must provide additional information about you and/or your Transactions as requested by Alipay to ensure compliance with anti-money laundering and other applicable laws.

2. Transaction Disputes and Chargebacks 

Alipay will handle Chargebacks, Transaction errors and reversals. If a Customer disputes a Transaction due to an Unauthorized Payment (as defined in Section 3 below), you must provide proof of goods or services delivery, including logistics or shipping certificates, receipt, recipient details, product names and prices, or other relevant information as required by Alipay.

3. Unauthorized Payments 

An “Unauthorized Payment” is a payment that has not been authorized by the Customer, including a payment made without obtaining the Customer’s authorization to activate the Auto-Debit Service (see Section 6). Alipay may suspend or terminate access to the Alipay services if high-risk Unauthorized Payments or fraudulent Transactions are detected. If precautionary measures are required by Alipay, you must adopt them within five (5) Business Days of notice. Failure to comply may result in suspension or termination of the Alipay services.

4. Compliance with Law 

You are solely responsible for ensuring that your use of the Alipay services complies with Law. You represent that the products and services you sell comply with Law and do not infringe any third-party intellectual property or proprietary rights. You are liable for any losses suffered by Alipay or Customers due to your non-compliance.

5. Termination for Regulatory Concerns 

Alipay may suspend or terminate your use of the Alipay services if you breach these Terms, including provisions related to prohibited and restricted products (see Section 7), or for any regulatory, compliance, or risk-related reasons. Alipay may take such actions immediately without prior notice.

6. Auto-Debit Service 

The terms of this Section 6 apply if you are enrolled in the Auto-Debit Service. “Auto-Debit Service” means a payment authorization model under which Alipay directly debits the Customer’s Alipay account for the payment upon your request and credits the requested payment to you without having to separately obtain authorization of Customers for each payment.

6.1 General Requirements

You are required to exclude Customers from the Auto-Debit Service if their Alipay account or selected Alipay funding source has been invalidated.

6.2 Payment Limit

Alipay may set a payment limit for the Auto-Debit Service to ensure compliance with regulatory requirements and internal risk control purposes. You must adhere to these limits.

6.3 Disclosure and Customer Authorization

You will accurately describe the Auto-Debit Service process on your platform and obtain Customer’s authorization before activating the Auto-Debit Service.

6.4 Trial Testing

Before enrolling Customers for the Auto Debit Service on your platform, if requested by Stripe or Alipay, you agree to undergo testing with Alipay and provide reasonable technical support during this phase. 

6.5 Customer Enrollment

You are responsible for entering into an enrollment agreement with Customers, meeting all authorization requirements.

6.6. Insufficient Balances

If insufficient funds in Customer’s Alipay account prevent processing, Alipay is not liable for any resulting claims, costs and losses incurred unless caused by Alipay’s negligence, fraud, or wilful misconduct.

6.7 Refunds

If a refund is necessary for any Transaction, you must process the refund using Alipay’s system interface. Alternative refund methods, such as bank transfers or membership account top-ups, are not permitted.

6.8 Permitted Products. 

Use of the Auto-Debit Service is restricted to approved products and the Auto-Debit Service must not be used for products inconsistent with the merchant category code provided during onboarding.

6.9 Unauthorized Payments

If Alipay notifies you that Unauthorized Payments processed through your platform are negatively impacting Alipay’s reputation, you must work with Alipay to implement designated risk controls within seventy two (72) hours of receipt of Alipay’s notification.  If these risks persist, Alipay may take corrective actions, including suspending or refusing to process high-risk or Unauthorized Payments. Alipay may also terminate your Auto-Debit Service access.

6.10 Termination

Customers must be able to terminate the Auto-Debit Service by submitting a termination request to either you or directly to Alipay. You are responsible for providing an accessible, user-friendly termination process for Customers on your platform, including technical and customer support throughout the process. If a termination request is filed with Alipay, Alipay will transmit the termination request to you via Stripe. 

You must promptly notify both Alipay and the Customer of the successful termination of the Auto-Debit Service. 

6.11 Customer Service

You must maintain a customer service process specifically for the Auto-Debit Service, including visible contact information. Inquiries and complaints related to the Auto-Debit Service must be addressed within seven (7) Business Days.  Unresolved matters will be escalated to the relevant Stripe and Alipay representatives, and these escalated cases must be addressed within seven (7) days of escalation. 

7. Prohibited and Restricted Products 

In addition to the categories of businesses prohibited or restricted from using Stripe, you may not use the Alipay services to sell products identified by Alipay as prohibited under the Prohibited Products list or restricted under the Restricted Products list. If Alipay determines that you are selling prohibited or restricted products, Alipay may instruct Stripe to suspend or terminate your use of the Alipay services.

  1. Information that endangers national security and other illegal political information
  2. Information promoting terrorism and extremist groups
  3. Information relating to hate speech and hate crime
  4. Other politically sensitive negative information
  5. Pornographic and/or erotic products, pictures, channels, and publications
  6. Pornographic and/or erotic services (including but not limited to sex chatting and prostitution)
  7. Gambling
  8. Lottery
  9. Gambling devices and accessories
  10. Toxic drugs, precursor chemicals and special addictive drugs
  11. Apparatus fit for use to take dangerous drugs
  12. Apparatus fit for use to produce dangerous drugs
  13. Firearms and ammunition, or military equipment
  14. Current army and police uniform (excluding cosplay costumes)
  15. Imitation firearms, firearm parts or equipment could cause bodily harm
  16. Controlled knives and weapons
  17. Poisonous or hazardous chemicals
  18. Explosives and explosive devices
  19. Radioactive materials
  20. Asbestos and products containing asbestos
  21. Ozone depleting materials
  22. Highly toxic pesticides
  23. Online sale of fireworks and firecrackers
  24. Medical toxic drugs, narcotics drugs, psychoactive drugs, radiopharmaceuticals and other controlled pharmaceutical products
  25. Psychedelic drugs, diet pills and health products containing prohibited ingredients
  26. Illegal sale of prescription drugs, unlicensed drugs, substandard drugs and other illegal drugs

  28. Surrogacy services
  29. Online sale of tobacco including cigarettes
  30. Online sale of electronic cigarettes, electronic cigarette liquids
  31. Human organs, body parts and remains
  32. Endangered and protected species and related products
  33. Endangered and protected plants and related products
  34. Pests and hazardous biological products
  35. Banking products and services (including all types of loans)
  36. Life insurance and investment return dividend insurance
  37. Stocks and securities
  38. Mutual Funds
  39. Loan platforms 
  40. Other financial products and services including various types of financial intermediation services
  41. Pawnbroker services
  42. Lucky draws (excluding fairly priced products e.g. Pop Mart) 
  43. Sale of financial information (e.g. bank accounts, bank cards)
  44. Illegal sale of payment acceptance terminals (excluding licensed acquirers and ISV)
  45. Monetary and financial certificates (e.g. deposit certificate, commercial paper)
  46. Trading or sale of virtual currencies and NFT
  47. Illegal encashment activities
  48. Illegal or unregistered fund-raising activities
  49. Crowdfunding
  50. Pyramid schemes and multi-level marketing

  52. Investment in precious metals (e.g. gold, silver) and jade (excluding gold and jewels as consumption goods)

  58. Espionage equipment and accessories (e.g. wiretapping and hidden camera)

  63. Mass texting equipment, software and services for illegal use, e.g. fraud (excluding legal marketing purposes)

  66. Sale of personal privacy information and other confidential information

  68. Goods or services used to improperly obtain traffic or popularity, e.g. click farm (excluding legal marketing purposes)

  71. Rewards of webcast and live streaming services (being activities that release real-time information to the public in the form of video, audio, graphics and words via internet (excluding sale of goods via webcasting on e-commerce platforms))

  74. Archaeological and state-protected cultural relics and fossils
  75. Investment immigration services
  76. Superstition services (e.g. Feng Shui, fortune-telling or tarot divination services)
  77. Collectibles with high investment value (e.g. antiques, art, calligraphy and painting) 
  78. Auctioned goods (e.g. Goods from Sotheby’s or Christie’s)
  79. Other goods or services that violate relevant PRC laws and regulations or adversely affect the reputation of the Ant Group
