1. Overview; Entities Providing Stablecoin Payments.
“Stablecoin Payments” is a Payment Method that enables you to accept payments in Stablecoin via the Settlement Services of a Settlement Services Provider. The Regional Terms located in Section 8 apply based on your Stripe Account Country. Capitalized terms used in these Payment Method Terms that are not defined here have the meaning given to them in the Stripe Services Agreement.
2. Settlement Services Providers.
Appendix A lists the Settlement Services Providers and their respective Settlement Services Terms. A Settlement Services Provider is a Financial Provider. By using Stablecoin Payments, you agree to the applicable Settlement Services Terms, which form an agreement between you and a Settlement Services Provider. Stripe may add or remove Settlement Services Providers, and the Settlement Services Terms may be updated by a Settlement Services Provider, at any time without notice to you. Any updated terms shall be deemed accepted by you if you continue to use Stablecoin Payments, and pay any related fees, after the relevant changes are made.
Where you provide instructions relating to Stablecoin Payments through the Stripe Dashboard (e.g., the instruction of a refund in Stablecoins), in doing so, you are providing instructions directly to the Settlement Services Provider.
3. Permitted Use; Disclaimers.
You may only use Stablecoin Payments to sell your goods and services to Customers. Your use of the Settlement Services is at your own risk, and to the maximum extent permitted by Law, Stripe disclaims all liability with respect to your use of the Settlement Services. Stripe is not liable to you for any losses, damages, or costs if you or any of your Customers provide incorrect transaction information, including an inaccurate or incomplete Deposit Address, or an incorrect wallet address to receive refunds. You must not make representations to your Customers that contradict, or are inconsistent with, these terms.
4. Depeg Event.
If a Depeg Event occurs, Stripe and the Settlement Services Provider may immediately (a) suspend Stablecoin Payments with respect to the affected Stablecoin, including suspending any new exchanges of fiat currency for the affected Stablecoin, or (b) continue providing Stablecoin Payments, at the affected Stablecoin’s prevailing Stablecoin-to-fiat market exchange rate. Stripe is not liable to you for any losses, damages, or costs arising from a Depeg Event, or any actions taken by Stripe or the Settlement Services Provider in connection with a Depeg Event, including any difference between the exchange rate applicable at the time you accept payment in Stablecoin and the rate at which the Settlement Services Provider executes the exchange, if it chooses to do so.
5. Payment Method Limitations; Customer’s Payment Obligation.
You acknowledge that (a) Stablecoin transactions cannot be cancelled, modified, or reversed once submitted to Stripe; (b) Stablecoin Payments does not support Disputes; and (c) a Customer’s obligation to pay you for a purchase of goods or services via Stablecoin Payments will be satisfied (or otherwise reduced by the value of the payment) when the applicable blockchain records a Customer’s deposit to your Settlement Services Merchant Account.
6. Taxes.
Transactions involving Stablecoins may be subject to Taxes. Stripe may send Tax forms to your Customers using the information the Customers have provided to Stripe. You acknowledge that Tax laws on Stablecoin transactions may be uncertain and that it is not Stripe's responsibility to determine, calculate, report or remit any Taxes owed by you arising from (a) the use of the Settlement Services, or (b) any other transactions you may enter into with a Settlement Services Provider. Stripe does not provide investment or tax advice.
7. Definitions.
“Depeg Event” means any occurrence where Stripe or the Settlement Services Provider determines, in its sole discretion, that the price of a Stablecoin has failed to maintain its intended peg to the fiat value to which it is linked.
“Deposit Address” means a Settlement Services Provider wallet address that a Settlement Services Provider provides to you for you to provide to your Customers for the purpose of buying goods or services from you in Stablecoin.
“Settlement Services” means the following services provided by a Settlement Services Provider: (a) the creation and maintenance of a Settlement Services Merchant Account and associated Deposit Address; (b) the conversion of Stablecoins to fiat currency and vice versa; (c) the custody of Stablecoins and fiat currency by the Settlement Services Provider; and (d) the transfer of fiat currency to your relevant Stripe Entity specified in Section 8.
“Settlement Services Merchant Account” means your account with a Settlement Services Provider in which Customers will be able to deposit Stablecoins using your Deposit Address.
“Settlement Services Provider” means the entity that provides the Settlement Services.
“Settlement Services Terms” means the terms that govern the Settlement Services Provider’s provision, and your access to and use of, the Settlement Services, and which may be updated from time to time.
“Stablecoin” means any fiat-backed cryptocurrency supported by Stablecoin Payments, which may be updated from time to time as stated in the Documentation.
“Stripe Services Agreement” means the Stripe services agreement between you and Stripe, located at www.stripe.com/[countrycode]/legal/ssa, where “[countrycode]” means the two-letter abbreviation for the country where the relevant Stripe Entity specified in Section 8 is located, or other written agreement with Stripe or its affiliate governing your use of the Stripe services.
8. Regional Terms.
United States.
The following Regional Terms apply if you are located in the United States.
8.1 Facilitating Fiat Settlement of Stablecoin Payments.
When you accept payments in Stablecoin via the Settlement Services of a Settlement Services Provider, Stripe Payments Company is the Stripe Entity that will settle fiat to your Stripe Account. This constitutes activity covered by Section 5.1 of the Regional Terms to the Stripe Financial Services Terms for the United States, located at www.stripe.com/legal/ssa-services-terms.
Stripe Payments Company is not otherwise involved in the provision of Stablecoin Payments, and does not pass your instructions to the Settlement Services Provider.
European Economic Area.
The following Regional Terms apply if you are located in the European Economic Area.
8.1 Facilitating Fiat Settlement of Stablecoin Payments.
When you accept payments in Stablecoin via the Settlement Services of a Settlement Services Provider, Stripe Technology Europe, Limited is the Stripe Entity that will settle fiat to your Stripe Account. This constitutes activity covered by Section 5.1 of the Regional Terms to the Stripe Financial Services Terms for the European Economic Area, located at www.stripe.com/legal/ssa-services-terms.
Stripe Technology Europe, Limited is not otherwise involved in the provision of Stablecoin Payments, and does not pass your instructions to the Settlement Services Provider.
Switzerland.
The following Regional Terms apply if you are located in Switzerland.
8.1 Facilitating Fiat Settlement of Stablecoin Payments.
When you accept payments in Stablecoin via the Settlement Services of a Settlement Services Provider, Stripe Payments UK Ltd is the Stripe Entity that will settle fiat to your Stripe Account. This constitutes activity covered by Section 5.1 of the Regional Terms to the Stripe Financial Services Terms for Switzerland, located at www.stripe.com/legal/ssa-services-terms.
Stripe Payments UK Ltd is not otherwise involved in the provision of Stablecoin Payments, and does not pass your instructions to the Settlement Services Provider.
Mexico.
The following Regional Terms apply if you are located in Mexico.
8.1 Facilitating Fiat Settlement of Stablecoin Payments.
When you accept payments in Stablecoin via the Settlement Services of a Settlement Services Provider, Stripe Payments Mexico, S. de R.L. de C.V. is the Stripe Entity that will act as payment method provider and agent in order to settle fiat to your Stripe Account. This constitutes activity covered by Section 5.1 of the Regional Terms to the Stripe Payments Services Terms for Mexico, located at www.stripe.com/legal/ssa-services-terms.
Stripe Payments Mexico, S. de R.L. de C.V. is not otherwise involved in the provision of Stablecoin Payments, and does not pass your instructions to the Settlement Services Provider.
Hong Kong.
The following Regional Terms apply if you are located in Hong Kong.
8.1 Facilitating Fiat Settlement of Stablecoin Payments.
When you accept payments in Stablecoin via the Settlement Services of a Settlement Services Provider, Stripe Payments Europe, Limited is the Stripe Entity that will settle fiat to your Stripe Account.
Stripe Payments Europe, Limited is not otherwise involved in the provision of Stablecoin Payments, and does not pass your instructions to the Settlement Services Provider.
