Stripe Linked Financial Accounts (the “Service”) enables you to link your financial account(s) to easily share your financial data with Stripe and to others that you authorize so that you can receive better product experiences. These Terms of Service (“Terms”) are a legal agreement between Stripe, Inc. (“Stripe,” “we,” or “us”) and you. By using this Service, you agree to be bound by these Terms, as amended by Stripe from time to time. You also agree to the Stripe ESign Agreement. It describes how we will communicate with you electronically. Your electronic agreement has the same effect as if you sign in ink.

1. General.

Financial data can be integral to enabling businesses to provide their customers with many different products and experiences. Stripe allows you to link your financial account(s) to enable Stripe and/or a Stripe merchant (also known as “your merchant”) to copy data from your linked financial account(s) and use that data to provide various products and services to you. For example, once you consent, your merchant may use your linked financial account(s) to help you transfer money, manage your spending, or facilitate your credit applications. Once you consent, Stripe may also use your data copied from your financial account(s) to, among other things, streamline your requested payments and to assess your eligibility for and offer you other products or services offered by Stripe or a Stripe affiliate. By enabling easier access to your financial data, Stripe powers a way to help connect you with new or enhanced product experiences.

The Service incorporates certain data and services provided by Data Sources. “Data Sources” means data aggregators (including Finicity Corporation), financial institutions and other service providers. The terms for Finicity Corporation, a Data Source, are available here and incorporated by reference in these Terms.

By using this Service, you consent to the collection, use, disclosure and retention of your financial data in the linked account and your personal data. Once connected to your financial account(s), Stripe and/or our Data Sources will regularly access, retrieve, and store the following types of data from your selected account(s):

  • Information about the account owner, including contact information (such as your name and address),
  • Account balances, including current and pending balances,
  • Account details, including your account type and bank, and account and routing numbers, and
  • Account transactions, including balance, transaction date, payee, location, transaction; description, and amount.

Stripe and/or our Data Sources may also obtain your financial institution login credentials, depending on the type of connection that Stripe has with your financial institution. Learn more.

Separately, we also capture common web analytics metadata such as your browser type, operating system, and IP address—which is sent by your browser to each website you access. We may also collect advanced fraud detection signals from your browser. We retain this information to help us prevent fraud, identify bugs and improve our services. Your merchant may also share information about you with us, including your name and contact information.

When you link a financial account, you are granting data access to Stripe and the following trusted entities:

  1. Merchants with whom you have consented to link an account.
  2. Our underlying Data Sources.
  3. If you process a payment with Stripe, we will also share the relevant details with our bank partners to enable the transaction.

We will use your personal data in accordance with Stripe’s Privacy Policy. We do not sell or rent your personal data. Stripe and Stripe’s Data Sources may use your data in an anonymized or aggregated manner (without identifying you personally) for any purpose permitted under applicable law, including to improve products and services, conduct analytic research and performance tracking, to assist in troubleshooting and technical support and other internal business purposes. Stripe’s Privacy Policy covers Stripe’s privacy practices, and not your merchant’s privacy practices. Stripe is not responsible or liable for the collection, use, disclosure, or retention of your personal data by your merchant. For information about how your merchant treats personal data, please refer to your merchant’s privacy policy.

If you want to unlink your account, you may do so by contacting Stripe at privacy@stripe.com or through our disconnection form, or by contacting your merchant. You may also request Stripe to delete the data obtained from your financial account and associated login credentials at privacy@stripe.com. If you would like to request your merchant to delete any copies of your data obtained through the Service that they may have created on their systems, please contact your merchant directly. Once Stripe and/or your merchant processes your request to unlink your account, Stripe and its Data Sources, along with your merchant, will no longer obtain future information from your unlinked account. If you would like to exercise any of your other privacy rights, please contact privacy@stripe.com or your merchant. Please also note that unlinking your account or deleting your personal data may not cancel or stop payments (including recurring payments) that you have already authorized. Please contact your merchant regarding inquiries concerning cancelling or stopping payments.

3. Using the Service.

When you obtain services from your merchant that has enabled this Service, Stripe will ask you to link your financial account(s). In order to use the Service, you will need to provide accurate, current and complete information about your identity and account. If you choose to link your financial account(s), until such time as you choose to unlink those accounts, you authorize Stripe, through our Data Sources or directly from your financial institution Data Source, to obtain and use data from your financial institution in the following ways. We will regularly obtain the data from your account(s) directly from your financial institution, retain a copy of that data, and also provide that data (or parts of that data) to your merchant. Alternatively, Stripe and/or its Data Sources will collect, retain, and use the login information required by your financial institution (such as your username and password) to regularly collect and transfer the data obtained from your account(s) to Stripe and your merchant.

Stripe may modify or terminate the Services at any time. You acknowledge that we may not be able to provide uninterrupted access to the Service, due to financial institution limitations or other constraints. If you believe that your account has been used for an unauthorized transaction, please contact your merchant or financial institution. If you have concerns about your financial account information, including your credentials, please contact Stripe.

You understand and acknowledge that the data obtained via the Service does not represent an official record of your account. You will not access the Service by macro or other automated means. Stripe is not acting on behalf of any Data Source in providing its application or services.

4. Stripe’s Role.

When you link your accounts with Stripe, Stripe will both hold a copy of your financial data, and where you have consented, share it (or parts of that data) with your merchant.

Stripe allows your merchant to offer you the option of linking your financial account(s) to enable your merchant to provide you with certain products and services. This Service does not change anything else about your relationship with your merchant or your financial institution. You are responsible for complying with the agreements that you have with your merchant and your financial institution. To the extent that your merchant uses this Service to facilitate payments, your merchant is the one responsible for providing you the goods or services that you are purchasing using this Service, not Stripe. Stripe also assumes no responsibility for any activities performed on your merchant’s app or site that are not made through this Service.

With your consent, Stripe may also obtain and use your data for Stripe’s purposes, consistent with Stripe’s Privacy Policy. Among other things, Stripe may use your data to:

  • Verify your bank account,
  • Facilitate the processing of your requested payments,
  • Mitigate fraud, financial loss, or other harm to you, your merchant, and Stripe,
  • Assess your eligibility for and offer you other Stripe products or services,
  • Analyze, develop, and improve this Service and Stripe’s other products and services,
  • Provide you customer support, including to help respond to your inquiries,
  • To maintain legal and regulatory compliance, and to enforce compliance with our Terms, and
  • For other purposes consistent with your consent and applicable law.

Stripe is not a Consumer Reporting Agency, and does not produce consumer reports (as defined by the Fair Credit Reporting Act (“FCRA”), 15 U.S.C. §1681 et seq.).

5. Selected Third Party Bank Account(s).

You agree that when Stripe and/or Stripe’s Data Sources accesses and retrieves your information from your selected financial account(s), Stripe and/or Stripe’s Data Sources are not the agent of the third party financial institutions. You agree that third party financial institutions shall be entitled to rely on this authorization granted by you. You also acknowledge that the Service is not endorsed or sponsored by any third party whose account(s) are accessible through the Service. You agree that Stripe is not responsible for the accuracy of data provided by your financial institution.

6. Proprietary Rights.

Using this Service does not grant you any intellectual property, proprietary or other rights to the Service. You also agree not to reverse engineer, disassemble, derive or otherwise transform, or attempt any of these acts, with respect to any of the technology used to provide this Service, whether owned or licensed by Stripe or any of its Data Sources. You also may not provide access to the Service to any third party.

7. Representations and Warranties.

By using this Service you represent and warrant that you: (a) are at least the age of majority in the jurisdiction in which you are located; (b) will not use this Service for any fraudulent, unlawful, abusive or unauthorized purpose; (c) have the lawful right to authorize us and our third party Data Sources to access your or your company’s financial account(s), and to use your financial data in the manner described in these Terms and our Privacy Policy; ; (d) will not access or attempt to access any other person’s account or provide another person’s information to us without proper authority to do so; (e) will not copy, modify or create derivative works based on this Service; (f) will not modify, reverse engineer or attempt to gain unauthorized access to this Service or any associated source code or other systems associated with this Service; (g) previously have not been terminated or suspended from using any other Stripe service, or (h) are not the subject of government sanctions, including those applied by the U.S Office of Foreign Assets Control or the government where you live.

8. Disclaimers.

THE SERVICE (INCLUDING ALL CONTENT, SOFTWARE, FUNCTIONS, MATERIALS, AND INFORMATION MADE AVAILABLE ON, PROVIDED IN CONNECTION WITH, OR ACCESSIBLE THROUGH THE SERVICE), IS PROVIDED “AS IS” AND “AS AVAILABLE.” STRIPE AND ITS AFFILIATES AND THEIR RESPECTIVE EMPLOYEES, AGENTS AND DATA SOURCES, AND YOUR MERCHANTS (COLLECTIVELY, THE “DISCLAIMING ENTITIES”), MAKE NO REPRESENTATION, WARRANTY, OR GUARANTEE, WHETHER EXPRESS, IMPLIED OR STATUTORY, FOR THE SERVICE OR THE CONTENT, DATA, INFORMATION AND FUNCTIONS MADE ACCESSIBLE BY THIS SERVICE, INCLUDING WITHOUT LIMITATION THE TIMING OF DELIVERY OF FUNDS (WHETHER OR NOT THE TIMING WAS IN STRIPE’S CONTROL), OR FOR ANY BREACH OF SECURITY ASSOCIATED WITH THE TRANSMISSION OF SENSITIVE INFORMATION THROUGH THE SERVICE. EACH DISCLAIMING ENTITY DISCLAIMS ANY REPRESENTATION, WARRANTY, OR GUARANTEE WITH RESPECT TO THE SERVICE, INCLUDING WITHOUT LIMITATION WARRANTIES OF NONINFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. THE DISCLAIMING ENTITIES DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE. THE DISCLAIMING ENTITIES WILL NOT BE RESPONSIBLE FOR ANY SERVICE INTERRUPTIONS, INCLUDING BUT NOT LIMITED TO, SYSTEM FAILURES OR OTHER INTERRUPTIONS THAT MAY AFFECT THE RECEIPT, PROCESSING, COMPLETION OR SETTLEMENT OF PAYMENT TRANSACTIONS. 9. Limitation of Liability

THIS SECTION LIMITS THE AMOUNT OF LIABILITY STRIPE HAS AND THE TYPES OF DAMAGES YOU CAN SEEK FROM STRIPE AND ITS DATA SOURCES. READ IT CAREFULLY.
TO THE FULLEST EXTENT ALLOWED BY LAW, IN NO EVENT WILL A DISCLAIMING ENTITY BE LIABLE FOR LOST PROFITS OR ANY DIRECT, INDIRECT, SPECIAL, EXEMPLARY, INCIDENTAL OR CONSEQUENTIAL, PUNITIVE, OR TORT DAMAGES OR OTHER INTANGIBLE LOSSES (INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF REPUTATION, LOSS OF DATA OR LOSS OF BUSINESS), EVEN IF ADVISED OF THE POSSIBILITY OF THE DAMAGE OR LOSS, ARISING OUT OF OR IN CONNECTION WITH (A) YOUR ACCESS TO OR USE OF THE SERVICES, (B) THE UNAVAILABILITY OR INABILITY TO USE THE SERVICES OR (C) PURCHASE OF THIRD-PARTY PRODUCTS OR SERVICES BASED ON OR THROUGH THE USE OF THE SERVICES.
YOU AND STRIPE EACH AGREE THAT THE OTHER HAS RELIED ON THE LIMITATIONS OF LIABILITY AND DISCLAIMER OF WARRANTY STATED ABOVE IN ENTERING INTO THESE TERMS, AND THAT THOSE LIMITATIONS ARE ESSENTIAL TO THE AGREEMENT BETWEEN YOU AND STRIPE. THE LAWS OF SOME COUNTRIES AND STATES PLACE RESTRICTIONS ON OUR ABILITY TO DISCLAIM OR LIMIT OUR LIABILITY. IN THOSE CASES, THIS SECTION WILL APPLY TO THE MAXIMUM EXTENT ALLOWED BY LAW.

10. Modification of Terms of Service; Notices.

To the extent permitted under applicable law, we have the right to change or add to these Terms at any time, solely with prospective effect, and to change, delete, discontinue, or impose conditions on use of the Service by posting such changes on our website or any other website we maintain or own. We will provide you with notice of any material changes to these terms via email, postings on our website, or through other reasonable means. If you are an existing user of the Service, the material changes will come into effect 10 days after we post the changes to our website, and your use of the Service more than 10 days after we publish any such changes on our website, constitutes your acceptance of the modified Terms. In the event that you do not agree with any such modification, your sole and exclusive remedy is to terminate your use of the Service through our disconnection form or by contacting Stripe support through our webform. You can access a current copy of these Terms on our website at any time. You can find out when these Terms were last changed by checking the “Last updated” date at the top of these Terms.

11. Your Liability For Third-Party Claims Against Us.

You agree to defend Stripe and its affiliates and their respective employees, agents, and Data Sources (each a “Stripe Entity”) against any claim, suit, demand, cost, loss, liability, damage, action, or proceeding (each a "Claim”) brought by a third party against a Stripe Entity, and you agree to fully reimburse the Stripe Entities for any Claim that results from:

  1. Your breach or alleged breach of any part of these Terms;
  2. Your improper use of the Service;
  3. Your violation of any third-party right, including any right of privacy, publicity rights, or Intellectual Property rights;
  4. The actions or inactions of any person to whom you grant permission to use or access the Services; or
  5. Your negligence or willful misconduct.

We reserve the right, at our own cost, to assume the exclusive defense and control of any Claim.

12. Termination, Suspension or Revocation of Access.

At any time, Stripe may terminate these Terms and suspend or revoke your access to the Service with or without notice and for any or no reason, including in the event of a suspected, attempted or confirmed breach of your obligations pursuant to these Terms. You may terminate these Terms that apply to you by closing your account or by notifying us at by contacting support through our webform.

13. General

  1. Governing Law: California law will govern any claim or dispute between you and Stripe that arises out of these Terms, regardless of conflict of law principles. You and Stripe each agree to exclusive personal jurisdiction in the state and federal courts located in San Francisco Country, California.
