BECS Direct Debit Service Terms and Conditions

Your Direct Debit Authority (“DDA”) is subject to the following terms and conditions.

1. By providing your details and confirming payment, you agree and acknowledge that Stripe New Zealand Limited (NZBN 5639473) (“Stripe”) acts as initiator on Merchant’s behalf to arrange for funds to be debited from your bank account as detailed in the DDA (“your account”). Stripe provides payment services to Merchant and Stripe does not provide any goods or services to you.

2. Merchant must give you a written notice of the amount and date of each direct debit no later than the date of the debit.

3. Merchant must also give you at least 10 days’ advance notice in the event of any subsequent change to the frequency or amount of the direct debits.

4. All notices will be in writing, and you agree that the notices may be delivered electronically.

5. You may ask your bank to reverse a direct debit up to 120 calendar days after the debit if:

  • a. You did not receive proper notice of the amount and date of the direct debit, or
  • b. You received notice but the amount or date of the direct debit is different from the date or amount specified in the notice.

6. If your bank dishonours a direct debit, but Stripe retries initiation of the debit within 5 business days of the original direct debit, you understand that you will not be notified again about the amount and date of the direct debit.

7. If you propose to query, amend or stop payment of any direct debit initiated under your DDA, you must give written notice to Merchant no less than 2 business days before the date the direct debit is due to be debited.

8. Your rights and responsibilities:

  • a. You must ensure that your account can accept debit instructions through the Bulk Electronic Clearing System (BECs).
  • b. You must ensure your account has sufficient funds to allow for debit transfers. If debit requests are returned to Stripe by your bank, Stripe may charge you a fee, in addition to any fees your bank may charge. If a debit request is returned to Stripe because your bank account has insufficient funds, it is your responsibility to fund the bank account so that Stripe can re-process the debit transfer.
  • c. If you change your account, you must ensure that your authorization will apply to any new account. You must provide Stripe and Merchant with any information regarding the new account and authorization as Stripe and Merchant deem necessary. You agree that Merchant may, upon Stripe and Merchant receiving written notice from a bank to which you have transferred your bank account, initiate direct debits in reliance of that written notice and your DDA from the account identified in the written notice.
  • d. You may cancel your authorization with your bank. However, you must also notify Stripe and Merchant promptly if you do so.
  • e. You have up to 9 months after the date Merchant sent the first direct debit under your DDA to query the validity of the authority that Merchant has to debit your account.

9. Stripe may collect and process your personal information for the purposes of processing your DDA. Please refer to Stripe’s privacy policy for further information.
